Welcome to HeftySend! These Terms and Conditions ("Terms") govern your use of the HeftySend application ("App"), provided by Massive Monkey Ltd. ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Use of the App

HeftySend allows you to send files from your device to another user via our servers ("Service"). To use the Service, you must:

• Be the age of majority in your jurisdiction.
• Use the App only for lawful purposes and in compliance with these Terms.
• Be responsible for maintaining the security of your device and any account credentials you use with the App.

We reserve the right to modify, suspend, or discontinue the App or any part of the Service at any time, with or without notice.

2. User Responsibilities

You agree that:

• You will not upload, send, or share any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable, including but not limited to pirated software, copyrighted material without permission, child exploitation material, or other prohibited content ("Illegal Content").
• You will not use the App to transmit viruses, malware, or any other harmful code.
• You are solely responsible for the files you send through the App, including their content and legality. We are not liable for any illegal file sharing conducted by users through the App.
• You will not attempt to reverse-engineer, hack, or interfere with the App's functionality or servers.

Illegal Content Detection and Consequences: We employ automated systems to detect Illegal Content. If you are found to be sharing Illegal Content, your account will be immediately terminated, and we will report your activity to the appropriate authorities in your country. You will have no right to appeal such termination.

3. File Transfers and Storage

Transmission: Files sent through HeftySend are transmitted via our servers to the recipient. We do not guarantee the speed or success of delivery, as this may depend on network conditions and file size.

Storage: Files are temporarily stored on our servers to facilitate your transfer. The App instantly deletes the transfers once the expiry time is reached, or if you delete the transfers from your account.

Size Limits: File transfers may be subject to size restrictions, which we may change at our discretion.

You agree not to upload or share:

• Illegal content
• Malicious software
• Content that infringes on intellectual property rights
• Harmful or offensive material

4. Intellectual Property

• You retain ownership of the files you upload and send through the App.
• By using HeftySend, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, transmit, and process your files solely to provide the Service, including the right to scan files for Illegal Content as described in Section 2.
• The App, including its design, code, and branding, is owned by Massive Monkey Ltd. and protected by copyright, trademark, and other intellectual property laws.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information, including how we monitor for Illegal Content. By using the App, you consent to such practices.

6. Disclaimers

• The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted service.
• We do not guarantee that files will be delivered successfully or that they will remain confidential if intercepted by third parties outside our control.
• We expressly disclaim any liability for illegal file sharing by users. Such actions are your sole responsibility, and we will cooperate fully with law enforcement if Illegal Content is detected.

7. Limitation of Liability

To the fullest extent permitted by law, Massive Monkey Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, profits, privacy, or damages resulting from illegal file sharing.

8. Termination

We may terminate or suspend your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. If our automated systems detect sharing Illegal Content, your account will be terminated immediately, and we will report you to the authorities in your country as outlined in Section 2. Upon termination, your right to use the App will cease immediately.

9. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

10. Refund Policy

We offer refunds within 30 days of purchase if you have a valid reason for dissatisfaction with our service. To request a refund:

• Contact our support team within 30 days of your purchase
• Provide your reason for requesting the refund
• Include your order or subscription details

Refund requests will be reviewed on a case-by-case basis. If approved, the refund will be processed using your original payment method.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Isle of Man, without regard to its conflict of law principles.
